I recently found a photocopy of a chapter written by Pound in "Philosophy of Law," "The End of Law." His concluding thought in a lengthy essay stating the aims of law - "......a continually more complete and effective elimination of waste and precluding of friction in human enjoyment of the goods of existence - in short a continually more efficacious social engineering." I say WOW - is this the underpinnings of a totalitarian society (Nazi, Communist, or what have you) or isn't it. And, who holds these would-be philosopher kings accountable? Of course, most contemporary law education, intelligentsia, etc. have bought Pound's views lock, stock and barrel. I grieve for what the U.S. is becoming. |
