Prior to the existence of Act 195, which permitted teachers to collectively bargain for the first time, Section 1142 of the School Code set forth a minimum salary schedule for teachers, requiring that teachers be paid at least the salary on the schedule corresponding to their years of full-time service in the district.
However, Section 1142 was not repealed because by reference in Section 1148, it continued to provide a minimum salary benchmark for substitute teachers, who generally were not covered by collective bargaining agreements.
Declaring that rights under Section 1142 were nonwaivable, the court also permitted the union to repudiate its own prior written agreements as to the correctness of the salary placement of each individual teacher.
