Abadiano testified, and there was no evidence to the contrary, that when Officer Asato first approached the Honda in his police Cushman, the engine of the Honda was running.
In Abadiano's case, the State asserts that the trial court erred in its finding of fact no. 18, when it stated that "[t]here appears to be no authority to perform the vehicle check" at the time that Officer Asato performed it.
