In a further clarification, today's action is revising the waste determination procedures such that for both point of waste origination and point of waste treatment, no distinction is made for batch or continuous processes or for whether the owner or operator is the generator or receives the waste from off-site.
As noted earlier, the increased VO concentration action level (from 100 ppmw to 500 ppmw) plus the inapplicability of the rule to hazardous wastes that meet the LDR standard for organic hazardous constituents should sharply reduce the number of situations where a metal-bearing waste undergoing stabilization would also be subject to the subpart CC standards.
