An Adjournment in Contemplation of Dismissal (or ACD) is a procedure in Criminal Law whereby a judge or other judicial official halts proceedings in a matter (most often a misdemeanor or traffic infraction) on the understanding it will be dismissed in a certain amount of time.[1] Criminal law (also known as penal law) is the body of statutory and common law that deals with crime and the legal punishment of criminal offenses. ...
The judge may impose conditions on the recipient of an ACD, such as community service or drug treatment. When dismissed, the case does not count as a conviction. However, the arrest record generally remains unless expunged.
The terminology used may vary from state to state. In Maryland, for example, it is termed "Probation before judgment." An ACD is provided for under New York law by NYS CPL Art. 170.55.
