Human Rights and Equal Opportunity Commission Website: Disability Rights (4110 words)
Airnorth's application is made on the basis that the airline does accept an obligation (under the Standards and under the DDA) to provide assistance where necessary for boarding and seating, but argues that implementation of this obligation is limited by occupational health and safety considerations, as well as requiring advance notice.
That complaint would fail if Airnorth and its staff were found in the circumstances to have been correct in deciding that lifting would breach occupational health and safety duties, but would succeed if Airnorth or its staff were found to have acted incorrectly in interpreting or applying their duties under occupational health and safety law.
Under the DDA and the Standards alike Airnorth would be able in appropriate cases to raise an unjustifiable hardship defence regarding a requirement for provision of an assistant by passengers, similar to that which was successfully raised in McLean v Airlines of Tasmania.
