In October 1997 AndrewOwusu, a British national domiciled in England, suffered a serious injury while on holiday at Mammee Bay in Jamaica.
Mr Owusu had rented his holiday accommodation from a Mr Jackson, another British national domiciled in England, who was named as first defendant in the proceedings that Mr Owusu commenced in England in an effort to obtain compensation.
In view of this ruling it is to be expected that the Court of Appeal will remove the stay on Mr Owusu's proceedings, retain jurisdiction and allow the action to proceed to trial in England (even if it is satisfied that Jamaica would be a more suitable forum).
The action arises out of a very serious accident to Mr Owusu when he was bathing in the sea on a holiday in Jamaica on 10 October 1997.
[7] After Mr Owusu had his accident, it came to his advisers' attention that another English holiday-maker, Alexandra Rickham, had had a similar accident two years earlier in which she, too, was rendered tetraplegic.
One new substantive point that he made was that two of his client's witnesses, namely Mr Owusu himself and Miss Rickham, had suffered significant injuries and it would be difficult for them to travel to Jamaica, and that all the witnesses in relation to causation and quantum resided in the United Kingdom.
