AutoNation, Inc. is the largest automotive retailer in the United States.[4] AutoNation has 272 dealerships nationwide, and employs approximately 27,000 employees. Autonation sells 37 different manufacturer brands nationwide. AutoNation outsells every other automotive retailer in the U.S. and is ranked #115 on the 2006 Fortune 500.[1] The company has a significant internet presence, offering its entire inventory for online searching.[5]

From its founding in 1996 until 1999, AutoNation operated a series of used car megastores under the AutoNation USA brand, designed in the image of rival CarMax. Competition and market forces drove the company to shutter its AutoNation USA stores and instead focus on conventional dealerships with unique brand names in each market. In 2007, an activist group named Stop! AutoNation sent individual dealerships letters threatening a boycott for alleged discrimination against customers and employees. However, the AutoNation parties allege in their verified motion to compel that, pursuant to two asset-purchase agreements executed in August 1999, they are corporate “successors-in-interest” to Green’s former employer, who had signed the arbitration agreement.
Furthermore, in response to questioning by the trial court, counsel admitted that (1) the AutoNation parties were “asset purchasers” and not “corporate successors” of the original signatories to the arbitration agreement, and (2) the employment arbitration agreements, such as Green’s, were not specifically recited in the asset-purchase agreements as assets purchased by the AutoNation parties.
Nevertheless, the AutoNation parties provided the trial court with affidavits and an authenticated “acknowledgment,” executed after this lawsuit was filed, as evidence that Green’s former employer and the AutoNation parties interpreted the language of the asset-purchase agreements as assigning all employment arbitration agreements to them.

AutoNation chief executive Michael J. Jackson, hired to revive the company in October, said the company has put growth plans on the back burner and will try to make what it owns work better.
