A BFPP must be in compliance with any land use restrictions established or relied on in connection with a response action that was taken to clean the property that the purchaser bought.
A BFPP must also provide full cooperation, assistance and access to persons who are authorized to conduct response actions or natural resource restoration at a facility from which there had been a release i.e., a brownfield.
The BFPP conducted an appropriate inquiry into the previous ownership and uses of the facility âin accordance with generally accepted good commercial and customary standards and practices.â By January 2004, the Environmental Protection Agency will issue a regulation establishing the standards and practices necessary to satisfy the requirements for an appropriate inquiry.
The BFPP cooperates, assists, and provides access to persons that are authorized to conduct environmental remediation activities, or response actions, on the property.
