The racial makeup of the CDP is 70.88% White, 4.08% Black or African American, 4.22% Native American, 1.17% Asian, 0.18% Pacific Islander, 13.41% from other races, and 6.06% from two or more races. 30.28% of the population are Hispanic or Latino of any race. The Cabazon Band argues that under these circumstances, the Cabazon Public Safety Department is an agency of the federal government for law enforcement purposes, and its vehicles are therefore authorized emergency vehicles under § 165(e).
The Cabazon Band also appears to argue that due to the operation of the Deputation Agreement, its tribal law enforcement vehicles are now subject to federal standards for BIA law enforcement vehicles, including a requirement that such vehicles have operational light bars.
Thus it is possible for Cabazon tribal law enforcement officers to comply with both the requirements of the Handbook and state law by simply covering their emergency lights when operating their vehicles on state highways off the reservation.

Cabazon interpreted the latter definition and decided to follow the Seminole's example of defining its casino/resort as a tribal economic engine eligible to receive the bonds.
Cabazon Chief Executive Officer Mark Nichols said the tribe is not using any of the money for its casino operation and has used it for other tribal projects that he claims are now more central to the tribe than its gaming operation.
Presumably, this is because of the Seminole decision and the Cabazon investigation.
