| December 2005, the Full Court has ruled in favour of the City of Mitcham effectively overturning the decisions of I M Farrell and Justice Hannon. The Full Court decision will stand now as the substantive authority regarding the application of the Availability Allowance provisions pursuant to Clause 5.4.1 of the Municipal Officers (SA) Award. |
| It should be noted that the Full Court found that the arrangement (supported by the evidence at first instance) did not have the character of direct "standby" and that it was clearly within the character of a "lesser state of readiness" as contemplated by Clause 5.4.1 (b) of the Award. |
