The Colorado Party, for its part, did not challenge a different provision of the statute-a provision that imposes a $5,000 limit on any contribution by a "multicandidate political committee" (including a coordinated expenditure) and which would apply to party coordinated expenditures if the entire Party Expenditure Provision were struck from the statute as unconstitutional.
Party spending "in cooperation, consultation, or concert with" a candidate therefore is indistinguishable in substance from expenditures by the candidate or his campaign committee.
Parties are left to wonder whether their speech is protected by the First Amendment when the Government can show-presumably with circumstantial evidence-a link between the Party and the candidate with respect to the speech in question.
