Connex South Eastern was a train operating company in the United Kingdom. It was owned by the Connex Group and operated between 1996 and 2003. The franchise was originally due to run until 2011, but in June 2003 the Strategic Rail Authority decided to cut the South Eastern franchise short at the end of 2003 due to what it called "poor financial management". Adjudication Connex South Eastern Limited v MJ Building Services Group plc (1074 words)
Connex SE submitted that it was "an abuse of process" for MJ to start adjudication proceedings so long after it purported on 29 November 2002 to accept a repudiation of the contract by Connex SE.
Connex SE submitted that Parliament was content for adjudication to take place after the cessation of work because this was seen in the context of a procedure which was (a) quick, (b) cheap and (c) a temporary decision.
Connex SE argued that if, as a result of the passage time, it was no longer possible to have a quick, cheap and temporary adjudication, then it was an abuse of process to permit an adjudication to take place.
SRA Blamed In Connex 'fiasco' - WhichOption (251 words)
The public accounts committee's report on the franchise found that Connex and the SRA did not communicate enough and that the SRA was slow to realise the difficulties Connex was in.
Connex was granted the 15-year south-eastern franchise in 1996 but it was terminated in 2003 after the SRA decided it was not doing enough to improve poor performance.
The committee did praise the transfer of the franchise to South Eastern Trains but said that there were lessons to be learnt for the future, adding that allowing "hope to triumph over experience" in franchise bids should never happen again.
