Encyclopedia > Control Denied

Control Denied was started by Chuck Schuldiner to create a European-style power metal/progressive metal band, mixed with elements death metal recognizable in his earlier band Death. The band was first started in 1996 as Schuldiner wanted to procur a slightly more melodic style than was possible with Death. The project was interrupted by a release of Death in 1998 but finally the debut album was released in 1999. A second album, tentatively titled When Machine And Man Collide, was partly recorded, but the demise of Schuldiner in 2001, put the recordings on hold. Remaining band members have expressed a wish to complete and release the material. However, there exists a legal dispute over the rights of the material with Karmageddon Records, further postponing the completion and release. FDIC: 1991 - Docket No. FDIC-91-19e (9219 words)
The FDIC's denial was affirmed by the ALJ, based, in part, on a finding that the competence and integrity of Respondent was such that it would not be in the interest of the Bank's depositors or the public to permit the proposed acquisition of control.
The Board holds that when one acquires control of an institution in spite of a previous denial of such control under the CBCA for lack of competence and integrity, such conduct is, by definition, an unsafe or unsound act.
The potential prejudice is further illustrated by Respondent's willingness to acquire control in violation of the CBCA and in spite of both the FDIC's and the ALJ's determinations that he lacked the competence and integrity under the CBCA.
