Wali turned himself in at a U.S. base in Afghanistan on June 18, 2003 to talk to authorities about rocket attacks against the base. He died three days later. Passaro was the first civilian to receive charges in connection with the prisoner abuse in Iraq and Afghanistan. The trial is scheduled for summer 2006 in Raleigh, NC, and he faces up to 40 years in prison and a $1 million fine.


U.S. District Court Judge Terrence Boyle will let Passaro's lawyer, Federal Public Defender Thomas P. McNamara, present evidence to a jury to bolster Passaro's claim that he was doing his job when he beat Wali.
