The Division of Moreton is an Australian Electoral Division in Queensland. The division was created in 1901 and is named after Moreton Bay. The Appellate Division also found that, due to the defendant fulfilling the filing deadline requirements, the lower court was warranted in refusing to accept the plaintiff’s opposing papers which were served the day before the motion’s due date.
The Appellate Division found that "although no notice of motion was served, the [Supreme] court considered the oral motion and also the affidavits in support of the motion in pursuance of the discretion conferred upon it by CPLR 2214 (c)" It held that such consideration was a proper exercise of discretion.
