The former clause concerns prevented Congress from prohibiting the slave trade until 1808; the latter required direct taxes to be apportioned among the states according to their populations. The United States has 50 states , so this means that the 13 smallest states (representing as little as 4% of the national population) could block an amendment desired by the remaining 37 states (representing as much as 96% of the national population). Congress approved these amendments as a block of twelve in September 1789, and the legislatures of enough states had ratified ten of those twelve by December 1791 to become part of the nation's highest legal document.
