Farm wineries differ from commercial wineries in that the fruit which is the source of the wine is usually produced on the farm, and the final product is also sold on the farm. on the premises of the farm winery or on property adjacent to and under the same ownership and control of said permittee within the state an average crop of fruit equal to not less than twenty-five per cent of the fruit used in the manufacture of the farm winery permittee's wine.
There are approximately eighteen farm wineries in the state and a manufacturer permit for a farm winery is currently $240 per year.
Current law requires a farm winery, as a condition for obtaining and holding its permit, to produce on its permitted premises an average crop of fruit at least equal to 25% of the fruit used to make its wine.

Therefore, during the 25 years in which self-distribution was allowed, farm wineries distributed their own wines, processed the same reports, collected the same taxes and promoted the same controls over alcohol as licensed wholesale distributors.
Since the farm winery bill was intended to promote Virginia agriculture, it did not allow out-of-state wineries the same rights, and the provision allowing self-distribution was declared unconstitutional by federal courts in 2005.
