Encyclopedia > Flag house Courts

Flag House Courts were a public housing project located in Baltimore, Maryland. Made up of three 12-story buildings, Flag House was built in 1955. They had recreational facilities with bingo and dances, a swimming pool, and a basketball court. However, the complex had problems right from the start. Elevators broke down often, trapping riders for hours. Residents were forced to run fans (even during winter) due to a faulty heating system that made the buildings unbearably hot, and then there was the usual robberies and drug dealing. But the problems only got worse. By the late 1960s, gunshots were not uncommon, drunks ran around making a lot of noise, people threw trash out their windows, vacant apartments were turned into drug hangouts, and stairwells became violent crime areas. In 1993, the projects were fixed up slightly, but that didn't help. They closed in 1998 and 1999 and were imploded in 2001. Register's Testimony: Piracy Prevention and the Broadcast Flag (3756 words)
While the subject matter of the broadcast flag proposal is technological, many of the comments submitted to the FCC arguing both for and against its adoption are rooted in copyright law.
The Court's 5-4 opinion addressed two issues: first, borrowing from the “staple article of commerce” doctrine in patent law, it ruled that secondary copyright liability could not be imposed based solely on the manufacture of copying equipment like the VCR where the device at issue “is capable of substantial noninfringing uses.”
The court concluded that “time-shifting merely enables a viewer to see such a work which he had been invited to see free of charge” and that therefore it was a “non-commercial” use.
