Florentino "the Ox" Fernandez (b. March 6, 1936) was a hard punching Cubanmiddleweight who fought from 1956-1972. He engaged in many memorable ring wars during his career. His overall record was 50 wins (43 by KO), 16 losses and two draws.
Many remember him for his one round knockout loss to Rubin "Hurricane" Carter, while others remember him best for his televised attempt to wrest the middleweight title from Gene Fullmer in Ogden, Utah on August 5, 1961. Fernandez lost on a split decision, which many felt was of the "hometown" variety. In any event, Fernandez fought a memorable fight, and hurt Fullmer many times throughout the bout with his potent left hook.
Florentino gained their trust to the point of being given the task of acquiring munitions of varying caliber and some arms.
Florentino was hardly known to the rest of the comrades as he had never attended any of the meetings.
Florentino said that a commander of the Holguín regiment had arrived, saying that there werent any problems within the military, that it was civilians who had attacked the Moncada garrison.
Fernandez was acquitted of the substantive charges of possession and importation of cocaine, but convicted of conspiracy to possess with intent to distribute and to import cocaine.
Fernandez now argues that the information contained in these reports either was known or should have been known to the government at the time of trial, was not divulged, and was exculpatory; in the alternative, he suggests that the news reports present newly discovered evidence that warrants an evidentiary hearing and a retrial.
Fernandez further argues that he cannot ascertain whether this evidence is Brady or newly discovered evidence because the in camera hearings held during the trial, during which Brady material was discussed, were held outside the presence of defense counsel and remain sealed.
