In the 1989 Supreme Court case, a Florida county sheriff received a tip that the Riley was growing marijuana in his backyard. Unable to see inside the greenhouse behind the defendant's mobile home, the sheriff circled over the defendant’s property using a helicopter. The marijuana could be seen growing inside the greenhouse. A warrant was obtained and marijuana was found in the greenhouse. The accused tried to have the evidence suppressed since he had a reasonable expectation that his activities within the greenhouse would remain private. The Florida Supreme Court agreed. Decision

The Supreme Court in a 5-4 vote reversed the decision arguing that the accused did not have a reasonable expectation that the greenhouse was protected from observation from a helicopter, and decided that therefore the helicopter surveillance did not constitute a search under the Fourth Amendment.
