Hagemeyer reserves the right in its sole discretion, either (a) to withhold shipments or (b) to impose or revise any credit limits on Customer's purchases when Hagemeyer deems itself insecure with respect to customer's ability to pay for the purchase order from time to time.
Neither Hagemeyer's acknowledgment of a purchase order nor Hagemeyer's failure to object to conflicting or additional terms and conditions in a purchase order shall be deemed an acceptance of such terms and conditions or a waiver of the provisions hereof.
If Hagemeyer's performance of any terms or provisions hereof shall be delayed or prevented because of any event which is not within the reasonable control of Hagemeyer, Hagemeyer may, at its option, suspend performance during the period such cause continues, and no liability shall attach against Hagemeyer on account thereof.
