Nystrom was frequently criticised for voting against the wishes of his constituents. Over the four decades that he represented Saskatchewan voters, he became more and more out of touch with ordinary residents of his riding. He voted in favour of gay marriage, he voted against legislating striking dockworkers back to work (which was costing grain farmers millions), and voted against minimum sentences for repeat offenders. He evemtually became identified with the big city socialism of the new NDP, and lost touch with the populist roots of the old Saskatchewan NDP. Spending almost all his time in Ottawa, Nystrom also gained the reputation of becoming "Ottawashed" and was rarely seen in the community he represented. He lost the seat to Andrew Scheer. Despite losing twice in federal elections, and losing the leadership three times, Nystrom decided to run again in the 2005 campaign.
