I do not believe it is the Minister's intention that children should be admitted to a programme of this nature in circumstances where it is contrary to the interests of the child to be admitted to such a programme.
The Minister spoke about striking a balance in the public context and the child victim is a member of the public who is entitled to ensure that the arrangements made, which could result in that child being asked to participate, take the best interests of that child victim into consideration.
The Minister stated that in a later criminal or civil proceeding behaviour that has resulted in a child being subject to the programme cannot be referred to in evidence.
