In England and Wales the post of ReturningOfficer is an honorary one, held by the High Sheriff of the county, and in practice the job is delegated to an Acting ReturningOfficer, who is a civil servant in the local authority.
In Hong Kong, the returningofficer is usually a judge.
The returningofficer shall, as soon as he has ascertained the result of the poll, forthwieth publicly declare the result and announce the candidate to whome most votes have been given to be elected as the member for the constituency.
A premature return shall be deemed not to have reached the Chief ElectionsOfficer until the same shoudl have reached him in due course, and he shall, if circumstances so require, sned back the return and any or all election documents connected therewith to the returningofficer for completion or correction.
Forthwith upon making the return to the writ in accordance with the provisions of section 44, the returningofficer shall cause the ballot boxes used thereat, with the locks and keys, to be deposited in the custody of the member of the police service in charge of a police station in the constituency.
