Privacy, Modified - Research Transition (6302 words) |
 | The transition period is available to covered entities who have an existing contract (or other written arrangement) with a business associate prior to the effective date of this modification, provided that the contract is not renewed or modified prior to the April 14, 2003, compliance date of the Privacy Rule. |
 | The transition provisions are intended to address the concerns of covered entities that the two-year period between the effective date and compliance date of the Privacy Rule is insufficient to reopen and renegotiate all existing contracts for the purposes of bringing them into compliance with the Rule. |
 | Similarly, the transition period does not relieve a covered entity of its responsibilities with respect to an individual's rights to access or amend his or her protected health information held by a business associate, or receive an accounting of disclosures by a business associate, as provided for by the Privacy Rule's requirements at Secs. |
