In early 1992, many people were talking about forming a new political party in online discussions in political forums. These discussions centered around populist, united themes. The eventual result of the movement that followed was United We Stand. It is possible this would have lasted longer with a more definite, but still broad platform. However, it did not (or has not) gained the groundswell support of local offices needed to sustain it as a full party.
Appeal from decision of the United States District Court for the Southern District of New York (Knapp, J.), granting plaintiff's motion for summary judgment against defendant Alex Rodriguez, denying defendant United We StandAmerica, New York, Inc.'s motion to vacate default judgment against it, and enjoining defendants' use of plaintiff's registered service mark.
United We StandAmerica, Inc. ("United") brought this action to enjoin the use of its registered service mark "United We StandAmerica" by defendants United We Stand, America New York, Inc. ("UWSANY") and Alex Rodriguez.
As United was the first user of the Mark, and UWSANY was well aware of United's prior use before UWSANY used it, the date of United's registration is irrelevant to the dispute.
