Good faith effort

U.S. Federal and state government are required to look for disabled, female, minority, and veteran business enterprises when bidding public jobs. Good faith, or in Latin bona fides, is the mental and moral state of honesty, conviction as to the truth or falsehood of a proposition or body of opinion, or as to the rectitude or depravity of a line of conduct, even if the conviction is objectively unfounded.
One who acts in good faith, so far as the violation of positive law (or even in certain junctures of natural law) is concerned, is said to labor under an invincible error, and hence to be guiltless.
In fact, good faith has been identified as the key essence of a contract, and the parties are expected to act in good faith in their dealings.
Good Faith Bad Faith in Government Contracts (675 words)
Good faith means different things in different contexts, but it has been described in the Restatement of Contracts as “faithfulness to an agreed common purpose and consistency with the justified expectations of the other party.” In the Uniform Commercial Code, good faith is broadly defined as “honesty in fact” in the matter at issue.
In those cases, courts and boards routinely hold that government officials are presumed to act conscientiously and in good faith in the discharge of their duties.
Tension arises between good faith and bad faith cases, because they suggest that, at least in the government contract arena, good and bad faith are not mirror images of one another.
